While she has done her level best to play the victim in the weeks following a recent court determination that Kelly Rutherford must return her children to their father, Daniel Giersch, word has it that she is really to blame for all that has happened in the custody battle. According to the latest gossip news updates, it was the Gossip Girl actress' actions that caused her ex-husband to have he's visa revoked in the US, in the first place -- directly leading to a judge deciding the only way to share custody was for the German business men to take the children to live with him in Monaco, where he resides. In the years since their split, Rutherford has publicly blamed everyone form her ex to the judges for having to go to Europe to visit her kids, but it seems that she was the real cause for her heartbreak all along.
If you were to ask Kelly Rutherford the reason that she doesn't have sole custody of her children she might give you a longwinded story about how her ex and insensitive judges have manipulated the legal system against her, but according to court documents that hardly seems to be the case.
In the latest September 7, issue of Star magazine excerpts from documents concerning the case show that almost everyone in involved has come to the same conclusion: Rutherford is trying to ruin her children's bond with their father.
"Kelly's failure to put Daniel on Helena's birth certificate is reflective of her general reluctance to facilitate the children's relationship with their father," wrote one judge.
And although Rutherford and her lawyer were reportedly able to have Giersch visa revoked, another custody expert assigned to the case concluded that Kelly was merely trying to manipulate the system to further damage her children's relationship with their father:
"Ms. Rutherford has engaged in conduct intended to interfere with Mr. Giersch relationship with the children...all safety concerns raised by Kelly were red herrings."
Even Rutherford's current lawyer's argument to People that Daniel had no right to get Monaco directly involved turned out to be disingenuous.
Attorney Wendy Murphy claims that Giersch promised to let California decide the case became a moot point, according to JD Supra, once the state determined that it no longer had any business ruling in the matter:
"In May 2015 a California judge granted her request for sole custody of the children...Two months later, on July 23, 2015, another order was entered by the California court, whereby, it ruled California no longer had jurisdiction to hear the custody case as Ms. Rutherford no longer resided in California.
"After filing for custody in New York less than four days later, Ms. Rutherford was informed by the New York courts that it also would not hear her case as New York did not have jurisdiction."
