South Korean court has order a forced arbitration between former EXO members Kris and Luhan and their former record label SM Entertainment. The two had filed separate contract nullification lawsuits. The decision is mandatory and will result in a binding decision between the two and SM Entertainment. Both former members had sued the record label because of what they felt were unfair working conditions and alleged favoritism shown towards Korean members of the band. Both are Chinese.
SM's team said it was because Luhan and Kris didn't provide sufficient enough reason.
"We are currently reviewing the forced arbitration ordered by the courts," said Kris and Luhan's legal representative. "We cannot release any specific information in regards to the case."
"When there is no concrete reason or proof to give up [their career] they hire the same attorneys to pursue the same goal," an SM rep revealed. "Once they debuted and promoted with the group [EXO] and had gained popular as a celebrity, each begin ignoring contracts made with that agency [SM Entertainment] and the agency's interests in order to leave for their own benefit."
Both Kris and Luhan are Chinese nationals and members of subgroup EXO-M. Both began their careers in China after leaving South Korea. In South Korea, disputes between employees and companies are usually settled through forced arbitration clauses that are included in contracts. Such cases waive the right of the employees to pursue further lawsuits.
This will be Kris’ third mediation with SM Entertainment and Luman’s second.
Each will have their lawyers present. As well, judges will be present. According to the website Kpostarz --
“Kris's suit against SM Entertainment was brought due to strict and strenuous schedules, exploitation of human rights and basic living conditions, as well as unfair distribution of profit. Luhan's suit claims that SM Entertainment unfairly favored EXO-K (the Korean subgroup) more than EXO-M.”
