Early Saturday morning Tracy Morgan and four other were critically injured when a tractor-trailer truck slammed into the comedians tour bus. The crash also tragically took the life of Morgan’s writer and fellow comedian James McNeil.
After the accident ABC News spoke with New Jersey State Police Sgt. First Class Gregory Williams who stated:
"Driver failed to observe slow-moving traffic ahead. He observed at the last minute -- just prior to impact -- the limo bus carrying Morgan and his party."
The driver has not been identified as Kevin Roper. Roper has been charged with one count of death by auto for the death of James McNeil and four counts of assault by auto for the additional passengers who were injured.
Roper was driving a Wal-Mart truck when he slammed into Morgan’s bus. Wal-Mart CEO Bill Simon has released a statement claiming that the company will take ‘full responsibility,” if it is determined that their truck was the cause of the accident:
"We are working quickly to understand what happened and are cooperating fully with law enforcement to aid their investigation. The facts are continuing to unfold. If it's determined that our truck caused the accident, Walmart will take full responsibility."
