The judge in Amanda Knox's most recent retrial has made remarks about the convicted murderers that have many questioning the man’s impartiality. Knox and her former boyfriend Raffaele Sollecito have both been acquitted once and convicted twice by the Italian courts. Lawyers for Sollecito are filing an appeal claiming that the magistrate’s remarks could form on of the cornerstones of their argument.
The judge in Amada Knox third murder trail Alessandro Nencini is coming under fire and investigation for comments he made to Italian newspaper regarding the inner machinations of the retrial.
The comments that most upset Sollecito's lawyer has to do with Nencini's comments about the defense's strategy, as well as remarks about the assigning of a motive being very controversial.
For his comments, the Florence judge is facing an internal investigation by his governing body to determine if his behavior warrents further reprimand according to Fox News:
"Members of the magistrate's governing body also said they will request an inquiry, saying Nencini had violated the secrecy of deliberations, anticipated arguments in the yet-published reasoning, and made comments on the defense trial strategy that suggest "partiality.'"
Nencini has been quoted as saying to Italian newspaper il Messaggero that Raffaele night have been hurt by his counsel's decision not to have him on the stand (via Fox):
"The ability not to be heard in a trial is a right, but it deprives the subject of a voice."
Nencini has since clarified to news agency ANSA that he never intended to further complicate things, but to the contrary he was hoping to simplify matters (via Fox):
"If my words generated a misunderstanding about the absolute legitimacy of the choice of a defendant to make voluntary statements, I regret it...My intention was to clear up possible misunderstandings."
Yeah...Yeah...Tell it to the judge.
